These Terms and Conditions (“Agreement”) govern all services and products provided by Studio Lina (“Studio Lina,” “we,” “us,” or “our”). By booking an appointment, participating in a body scanning session, purchasing a product, or approving a custom order, the client (“Client”) agrees to be legally bound by this Agreement.

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan.

1. Appointments and Booking

All appointments must be scheduled at least forty-eight (48) hours in advance, except where Studio Lina expressly offers last-minute availability. A booking is not confirmed until written confirmation has been provided by Studio Lina. Studio Lina reserves the right to refuse, reschedule, or cancel appointments at its discretion. Clients are responsible for providing accurate contact information at the time of booking.

2. Cancellation Policy

Appointments may be canceled or rescheduled up to twenty-four (24) hours prior to the scheduled appointment time. Cancellation requests must be submitted via email to hello@studiolina-art.com.

Cancellations made less than 24 hours prior to the scheduled appointment may result in a cancellation fee ($50). Failure to attend an appointment without notice (“no-show”) may result in forfeiture of any deposit paid and may require full prepayment for future bookings.

3. Custom Pregnancy Sculpture Orders

All pregnancy sculptures are custom-made artworks created from a digital 3D body scan of the Client.

During the consultation, the Client and Studio Lina will determine the final sculpture size and finish, including color and artistic treatment.

Production of the sculpture will begin only after full payment of the agreed amount has been received.

Once the payment has been made, the order becomes final and non-refundable due to its personalized and custom-produced nature.

Minor variations in color, texture, or finish may occur as a result of the handcrafted artistic process and shall not be considered defects. Studio Lina retains artistic discretion while respecting agreed specifications.

4. Payments

Full payment is required prior to production unless otherwise agreed in writing. Studio Lina reserves the right to withhold production or delivery until payment has cleared. Prices are subject to change without notice prior to booking confirmation.

5. Privacy and Portfolio Use

Studio Lina reserves the right to photograph and display completed and sculptures in process for portfolio, website, exhibition, and social media marketing purposes. All sculptures will be displayed anonymously. No personally identifying information will be published without explicit written consent. If the Client does not wish for their sculpture to be used for promotional purposes, they must notify Studio Lina in writing by sending an email to hello@studiolina-art.com

6. Data Storage and Digital Files

The digital 3D scan file created during the scanning session will be securely stored for a period of three (3) years from the date of creation. After the three-year retention period, Studio Lina reserves the right to permanently delete the digital file without further notice.

Clients may request a copy of their digital 3D file for personal use for a fee of $49. Upon receipt of payment, the file will be delivered in its available format. Studio Lina does not guarantee compatibility with third-party software, editing tools, or printing services.

7. Intellectual Property

All intellectual property rights, including but not limited to copyrights, artistic modifications, designs, photographs, and digital files created by Studio Lina, remain the exclusive property of Studio Lina.

Purchase of a physical sculpture transfers ownership of the physical object only. No copyright, reproduction rights, commercial rights, or design rights are transferred to the Client.

The Client may not reproduce, modify, duplicate, scan, distribute, sell, or commercially exploit the sculpture or digital file without prior written consent from Studio Lina.

8. Shipping, Risk of Loss, and Damage

If shipping is requested, Studio Lina will package the sculpture with reasonable care and appropriate protective materials.

Title and risk of loss transfer to the Client upon delivery of the sculpture to the shipping carrier. Studio Lina is not responsible for loss, delay, or damage caused by third-party shipping providers.

If a sculpture arrives damaged, the Client must notify Studio Lina within forty-eight (48) hours of delivery and provide clear photographic evidence of the damaged item and packaging. Any compensation for damage is subject to the shipping carrier’s insurance and claims procedures.

Studio Lina is not responsible for damage resulting from improper handling, environmental exposure, accidental impact, or storage conditions after delivery.

9. Waiver and Release of Liability

Participation in a 3D body scanning session is voluntary. The Client acknowledges that the scanning process requires standing still for a short period of time while digital imaging equipment captures body contours.

The Client confirms that they are physically able to safely participate. The Client voluntarily assumes all risks associated with participation, including but not limited to temporary discomfort, fatigue, or loss of balance.

To the fullest extent permitted under Michigan law, the Client releases and discharges Studio Lina, its owner, employees, contractors, and representatives from any and all claims, demands, damages, or causes of action arising out of or related to participation in the scanning session or presence on the studio premises, except in cases of gross negligence or willful misconduct.

For pregnant clients, the Client acknowledges that:

The scanning service is cosmetic and artistic in nature;
No medical advice is provided;
The Client has consulted a healthcare provider if they have concerns regarding participation.

The Client agrees to indemnify and hold harmless Studio Lina from any claims, damages, liabilities, or expenses (including reasonable attorney’s fees) arising from participation in services, misuse of digital files, or breach of this Agreement.

10. Limitation of Liability

To the fullest extent permitted by Michigan law, Studio Lina shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to services or products provided.

Studio Lina’s total liability for any claim shall not exceed the amount paid by the Client for the specific product or service giving rise to the claim.

11. Governing Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan.

Any disputes arising under this Agreement shall be resolved in the appropriate state or federal courts located in Michigan.

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Acceptance of Terms

By booking an appointment, participating in a scanning session, approving a digital scan, or purchasing a sculpture, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
